These Terms of Service govern your use of the Diariolapalabra website (www.diariolapalabra.co.uk) and mobile applications operated by Diariolapalabra Ltd, a company registered in England and Wales (Company No. 07823941), with registered office at 47 Carnaby Street, Soho, London W1F 9PT.
2. Acceptance of Terms
By accessing our website or placing an order, you agree to be bound by these Terms of Service, our Privacy Policy, and our Cookie Policy. If you do not agree, please do not use our services.
You must be at least 18 years of age to create an account or place an order. By using our services, you confirm that you meet this requirement.
3. Ordering
When you place an order through our website or app, you are making an offer to purchase. We reserve the right to accept or decline any order. Your order is confirmed when you receive an order confirmation email from us.
All menu items are subject to availability. Prices are displayed in Pounds Sterling (ÂŖ) and are inclusive of VAT at the applicable rate. We reserve the right to change prices at any time.
Delivery is available within defined zones around each store. We will notify you if we cannot deliver to your address.
4. Delivery
We aim to deliver within 30 minutes, but delivery times are estimates only and may vary depending on demand, traffic and other factors. We are not liable for delays outside our reasonable control.
Delivery charges are shown at checkout and vary by order value and location. Orders over ÂŖ20 qualify for free delivery from most locations.
5. Cancellations and Refunds
You may cancel your order within 5 minutes of placing it for a full refund. After this time, your order will have entered preparation and cannot be cancelled.
If your order arrives incorrect or is of unacceptable quality, please contact us within 24 hours and we will arrange a replacement or refund as appropriate. Photographic evidence may be required.
Refunds are processed within 3â5 business days to the original payment method.
6. Promotional Offers and Loyalty Points
Promotional codes are subject to their own specific terms and may have expiry dates, minimum order values, or other restrictions. Only one promotional code may be applied per order.
Loyalty points are earned at a rate of 1 point per ÂŖ1 spent. Points are worth ÂŖ0.10 each when redeemed (10 points = ÂŖ1). Points expire after 12 months of account inactivity.
7. Allergen Information
We take allergen safety extremely seriously. Full allergen information is available on our Allergen Information page. However, our kitchens are not allergen-free environments. If you have a severe food allergy, please contact your nearest store directly before ordering.
8. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, and software, is owned by or licensed to Diariolapalabra Ltd and is protected by applicable intellectual property laws. You may not reproduce, distribute or create derivative works without our express written permission.
9. Limitation of Liability
To the fullest extent permitted by law, Diariolapalabra Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the value of the order in question.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email or a notice on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
